Consent and Authorization
Opt-in requirement: You represent and warrant that you will obtain all required consents and authorizations from message recipients before sending marketing or informational SMS messages using the Service.

Permitted content: Messages must comply with applicable laws and industry rules and must not contain unlawful, deceptive, harassing, or otherwise prohibited content.
Accountability and Compliance
Customer responsibility: Funeral homes and other customers using the Service are responsible for ensuring their message lists, opt‑in records, and message content comply with all applicable laws, regulations, and carrier rules.
Recordkeeping: You must maintain records of opt‑ins, consent language, and any required disclosures for the period required by law. Metahosted may request proof of consent to investigate complaints or regulatory inquiries.
Message Types
Transactional messages: Messages necessary to provide the Service (appointment confirmations, scheduling updates, service notifications) are permitted even if the recipient has opted out of marketing messages, unless the recipient explicitly revokes all messaging consent.
Marketing messages: Promotional or marketing communications require explicit prior consent from the recipient.
How to Opt Out
SMS opt-out: Recipients may opt out of receiving marketing SMS messages at any time by replying STOP to any message. After receiving STOP, we will send a confirmation and will not send further marketing SMS messages to that number unless the recipient later opts back in.
Help and support: Recipients may reply HELP to receive information on how to get assistance or contact the sender.
Phone and email opt-out: Recipients may also opt out of calls or email marketing by contacting the funeral home directly or contacting Metahosted at [email protected].
Processing Opt Out
Timely action: Opt‑out requests will be processed promptly. Opting out of marketing messages does not necessarily stop transactional or service‑related messages unless explicitly requested and permitted by law.
No fees for opting out: There is no charge to opt out; standard carrier messaging rates may still apply for messages sent prior to processing the opt‑out
Message Frequency
TVariable frequency: Message frequency depends on the funeral home’s use of the Service and the recipient’s interactions. Typical message frequency may range from occasional notifications to multiple messages per week depending on scheduling, confirmations, and follow‑ups.
Expectation setting: We will provide reasonable estimates of expected message frequency when requested, but actual frequency may vary.
Standard Rates Apply
Carrier charges: Standard message and data rates apply as determined by the recipient’s mobile carrier. Recipients are responsible for any carrier or data charges incurred.
International charges: International messaging or roaming charges may apply for recipients outside the United States; recipients should consult their carrier for details.
Prohibited Uses
No unlawful messaging: You may not use the Service to send unlawful, spam, or unsolicited messages in violation of applicable laws or carrier policies.
Abuse and fraud: Metahosted reserves the right to suspend or terminate accounts that engage in abusive, fraudulent, or noncompliant messaging practices.
Enforcement Actions
Suspension and termination: We may suspend or terminate access to the Service, block sending privileges, or remove content if we reasonably determine that your use violates these Terms or applicable law.
Liability for violations: You remain responsible for all messages sent from your account and for any fines, penalties, or damages arising from noncompliant messaging.
Carrier liability disclaimer
Message delivery is subject to carrier networks; carriers are not responsible for message content or delivery failures.
We do not guarantee delivery, timeliness, or confidentiality of messages and are not responsible for delays, failures, or errors caused by carriers, network outages, or third‑party providers.
We are not responsible for what use Mobile carriers make of your mobile phone numbers or how they share your information
Age restriction
You must be 18 years or older to provide a phone number or opt in to receive marketing messages from Metahosted LLC. If you are under 18, do not provide your phone number; parents or guardians should contact us for assistance.
Modifications
Changes to Terms: Metahosted may modify these Terms from time to time. We will post the revised Terms with an updated effective date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
Disclaimers and Limitation of Liability
No warranty: The Service is provided “as is” and “as available.” Metahosted disclaims all warranties to the fullest extent permitted by law.
Limitation of liability: To the maximum extent permitted by law, Metahosted’s liability for claims arising from or related to these Terms or the Service is limited as set forth in your service agreement with Metahosted.
Governing Law
Applicable law: These Terms are governed by the laws specified in your service agreement with Metahosted and applicable U.S. law.
